Terms & Conditions

These Terms & Conditions govern access to and use of ARCHOS, including our web application, mobile-ready interfaces, reports, payment workflows and related support services.

Commercial terms

Subscription-based access

ARCHOS is provided as a subscription software service, with plan access, billing cycles and support terms defined by the customer’s plan or order form.

Customer control

You own your project data

Customers retain rights in the data they upload, while ARCHOS retains rights in the software, workflows, interface and supporting documentation.

Operational reliability

Reasonable service commitments

We aim for dependable uptime, but customers should expect planned maintenance windows, occasional interruptions and evolving product capabilities.

Use of service

Business platform access

ARCHOS is intended for business and professional construction workflows. You are responsible for using the service in compliance with applicable law and your internal policies.

Billing

Recurring subscription terms

Paid plans renew according to the billing cycle selected at purchase unless cancelled in accordance with the applicable plan and refund terms.

Platform ownership

Software and documentation rights

All rights in the platform software, product content, user interface, branding and supporting materials remain with ARCHOS and its licensors.

Platform usage

ARCHOS grants customers a limited, non-exclusive, non-transferable right to access and use the platform during an active subscription solely for internal business operations.

Use of the service must stay within the customer’s authorized seats, project limits and commercial package. Customers may not resell, sublicense or expose the platform to unauthorized third parties unless expressly approved in writing by ARCHOS.

Account responsibilities

  • Customers are responsible for keeping account credentials secure and ensuring user lists remain current.
  • Administrators must assign permissions carefully and revoke access for users who no longer require it.
  • Customers are responsible for the legality, accuracy and completeness of information uploaded or shared through ARCHOS.
  • You must notify ARCHOS promptly if you suspect unauthorized access, compromised credentials or security incidents affecting your workspace.

Acceptable use

ARCHOS may not be used in a way that disrupts the service, violates law or harms other users.

  • Do not use the platform to upload unlawful, infringing, fraudulent, abusive or malicious content.
  • Do not attempt to reverse engineer, probe, disrupt or gain unauthorized access to the platform, infrastructure or other customer workspaces.
  • Do not use ARCHOS to transmit malware, spam, credential-harvesting attempts or misleading communications.
  • Do not misrepresent project, billing or identity information in order to bypass controls or obtain services improperly.

Enforcement

ARCHOS may suspend or restrict access where we reasonably believe a user or customer is violating these terms, threatening platform integrity or creating legal or security risk.

Subscription and payment terms

Paid subscriptions are billed in advance on a monthly, quarterly or annual basis, depending on the selected plan or signed order form. Taxes, duties or other government charges may be added where applicable.

By activating a paid plan, the customer authorizes ARCHOS or its payment processor to charge the selected payment method for recurring subscription fees, approved add-ons, renewal charges and any applicable taxes.

  • Customers must provide accurate billing information and keep payment methods current.
  • Failure to collect payment may result in reminders, restricted access, account suspension or cancellation after reasonable follow-up.
  • Discounted promotional pricing, pilot arrangements and custom enterprise terms apply only for the agreed period and may change at renewal unless otherwise confirmed in writing.

Project ownership and customer content

Customers retain ownership of the project data, documents, comments, records and other content they submit to ARCHOS. The customer grants ARCHOS the limited rights necessary to host, process, display, back up and transmit that content in order to operate the service.

Customers are responsible for obtaining any consent or authorization needed to upload workforce, vendor, site or project information to the platform.

Intellectual property

ARCHOS and its licensors retain all rights, title and interest in the platform, software logic, interface design, documentation, analytics methods, compiled reports, trademarks and branding, excluding customer content.

Feedback or feature suggestions submitted by customers may be used by ARCHOS to improve the product without obligation, provided such use does not identify confidential customer information publicly.

Service interruptions and changes

ARCHOS aims to provide a reliable service, but the platform may occasionally be unavailable because of scheduled maintenance, infrastructure events, internet outages, third-party failures, security responses or force majeure events.

We may update, improve, modify or discontinue features from time to time. Where practical, we will provide reasonable notice before material changes that significantly affect the customer experience.

Termination rights

Customers may stop using ARCHOS at any time and may cancel paid subscriptions in accordance with the applicable billing cycle and refund policy. Access to paid features typically continues through the end of the paid term unless terminated earlier for cause.

ARCHOS may suspend or terminate access for non-payment, material breach of these terms, suspected fraud, security concerns, misuse of the platform or legal compliance reasons.

Liability limitations

ARCHOS is provided on an as-available basis. To the maximum extent permitted by law, ARCHOS disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement.

ARCHOS is not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, data loss, project delays or reputational harm arising from use of or inability to use the service.

Where liability cannot be excluded, ARCHOS’s aggregate liability relating to the service will not exceed the subscription fees paid by the customer to ARCHOS for the three months preceding the event giving rise to the claim.

Dispute resolution

If a dispute arises, the parties should first attempt to resolve it informally by contacting support@archos.in and providing a detailed written description of the issue.

Unless a different process is required by a signed agreement or applicable law, these terms are governed by the laws of India and disputes will be subject to the competent courts located in the customer contract jurisdiction specified by ARCHOS at the time of contracting.

If a signed order form, enterprise agreement or custom subscription schedule conflicts with these terms, that specific commercial agreement will control to the extent of the conflict.
